Menimbang :
bahwa dalam rangka memberikan kepastian hukum kepada Wajib Pajak mengenai pelaksanaan ketentuan peralihan Peraturan Pemerintah Nomor 71 Tahun 2008 tentang Perubahan Ketiga atas Peraturan Pemerintah Nomor 48 Tahun 1994 tentang Pembayaran Pajak Penghasilan atas Penghasilan dari Pengalihan Hak atas Tanah dan/atau Bangunan, perlu menetapkan Peraturan Direktur Jenderal Pajak tentang Pelaksanaan Ketentuan Peralihan Peraturan Pemerintah Nomor 71 Tahun 2008 tentang Perubahan Ketiga atas Peraturan Pemerintah Nomor 48 Tahun 1994 tentang Pembayaran Pajak Penghasilan atas Penghasilan dari Pengalihan Hak atas Tanah dan/atau Bangunan;
Mengingat :
1. Undang-Undang Nomor 6 Tahun 1983 tentang Ketentuan Umum dan Tata Cara Perpajakan (Lembaran Negara Republik Indonesia Tahun 1983 Nomor 49, Tambahan Lembaran Negara Republik Indonesia Nomor 3262) sebagaimana telah beberapa kali diubah terakhir dengan Undang-Undang Nomor 16 Tahun 2009 (Lembaran Negara Republik Indonesia Tahun 2009 Nomor 62);
2. Undang-Undang Nomor 7 Tahun 1983 tentang Pajak Penghasilan (Lembaran Negara Republik Indonesia Tahun 1983 Nomor 50, Tambahan Lembaran Negara Republik Indonesia Nomor 3263) sebagaimana telah beberapa kali diubah terakhir dengan Undang-Undang Nomor 36 Tahun 2008 (Lembaran Negara Republik Indonesia Tahun 2008 Nomor 133, Tambahan Lembaran Negara Republik Indonesia Nomor 4893);
3. Peraturan Pemerintah Nomor 48 Tahun 1994 tentang Pembayaran Pajak Penghasilan atas Penghasilan dari Pengalihan Hak atas Tanah dan/atau Bangunan (Lembaran Negara Republik Indonesia Tahun 1994 Nomor 77, Tambahan Lembaran Negara Republik Indonesia Nomor 3580) sebagaimana telah beberapa kali diubah terakhir dengan Peraturan Pemerintah Nomor 71 Tahun 2008 (Lembaran Negara Republik Indonesia Tahun 2008 Nomor 164, Tambahan Lembaran Negara Republik Indonesia Nomor 4914);
4. Keputusan Menteri Keuangan Nomor 635/KMK.04/1994 tentang Pelaksanaan Pembayaran Pajak Penghasilan atas Penghasilan dari Pengalihan Hak atas Tanah dan/atau Bangunan sebagaimana telah beberapa kali diubah terakhir dengan Peraturan Menteri Keuangan Nomor 243/PMK.03/2008;
MEMUTUSKAN :
Menetapkan :
PERATURAN DIREKTUR JENDERAL PAJAK TENTANG PELAKSANAAN KETENTUAN PERALIHAN PERATURAN PEMERINTAH NOMOR 71 TAHUN 2008 TENTANG PERUBAHAN KETIGA ATAS PERATURAN PEMERINTAH NOMOR 48 TAHUN 1994 TENTANG PEMBAYARAN PAJAK PENGHASILAN ATAS PENGHASILAN DARI PENGALIHAN HAK ATAS TANAH DAN/ATAU BANGUNAN.
Pasal 1
(1) Wajib Pajak badan, termasuk koperasi, yang usaha pokoknya melakukan transaksi pengalihan hak atas tanah dan/atau bangunan, yang:
1. melakukan pengalihan hak atas tanah dan/atau bangunan sebelum tanggal 1 Januari 2009 dan atas pengalihan hak tersebut belum dibuatkan akta, keputusan, perjanjian, kesepakatan, atau risalah lelang oleh pejabat yang berwenang; dan
2. penghasilan atas pengalihan hak sebagaimana dimaksud pada huruf a telah dilaporkan dalam Surat Pemberitahuan Tahunan Pajak Penghasilan tahun pajak yang bersangkutan dan Pajak Penghasilan atas penghasilan tersebut telah dilunasi,
pengenaan pajaknya dihitung berdasarkan ketentuan Peraturan Pemerintah Nomor 48 Tahun 1994 tentang Pembayaran Pajak Penghasilan atas Penghasilan dari Pengalihan Hak atas Tanah dan/atau Bangunan sebagaimana telah beberapa kali diubah terakhir dengan Peraturan Pemerintah Nomor 79 Tahun 1999 tentang Perubahan Kedua atas Peraturan Pemerintah Nomor 48 Tahun 1994 tentang Pembayaran Pajak Penghasilan atas Penghasilan dari Pengalihan Hak atas Tanah dan/atau Bangunan.
(2) Atas penghasilan dari pengalihan hak atas tanah dan/atau bangunan yang memenuhi ketentuan sebagaimana dimaksud pada ayat (1) tidak dikenai Pajak Penghasilan berdasarkan ketentuan Peraturan Pemerintah Nomor 71 Tahun 2008 tentang Perubahan Ketiga atas Peraturan Pemerintah Nomor 48 Tahun 1994 tentang Pembayaran Pajak Penghasilan atas Penghasilan dari Pengalihan Hak atas Tanah dan/atau Bangunan yang dibuktikan dengan surat keterangan bebas pembayaran Pajak Penghasilan yang bersifat final.
Pasal 2
(1) Permohonan untuk memperoleh surat keterangan bebas pembayaran Pajak Penghasilan yang bersifat final sebagaimana dimaksud dalam Pasal 1 ayat (2) diajukan secara tertulis oleh Wajib Pajak badan yang melakukan pengalihan hak atas tanah dan/atau bangunan ke Kantor Pelayanan Pajak tempat Wajib Pajak badan yang bersangkutan terdaftar dengan format sesuai Lampiran I yang tidak terpisahkan dari Peraturan Direktur Jenderal Pajak ini.
(2) Permohonan untuk memperoleh surat keterangan bebas pembayaran Pajak Penghasilan yang bersifat final sebagaimana dimaksud pada ayat (1) harus dilampiri dengan daftar tanah dan/atau bangunan yang penghasilan atas pengalihannya telah dilaporkan dalam Surat Pemberitahuan Tahunan Pajak Penghasilan dengan format sesuai Lampiran II yang tidak terpisahkan dari Peraturan Direktur Jenderal Pajak ini.
Pasal 3
(1) Atas permohonan surat keterangan bebas pembayaran Pajak Penghasilan yang bersifat final sebagaimana dimaksud dalam Pasal 2 ayat (1), Kepala Kantor Pelayanan Pajak harus memberikan keputusan dalam jangka waktu paling lama 10 (sepuluh) hari kerja sejak tanggal surat permohonan surat keterangan bebas pembayaran Pajak Penghasilan yang bersifat final diterima secara lengkap.
(2) Apabila dalam jangka waktu sebagaimana dimaksud pada ayat (1) Kepala Kantor Pelayanan Pajak tidak memberikan keputusan, permohonan sebagaimana dimaksud pada ayat (1) dianggap dikabulkan dan Kepala Kantor Pelayanan Pajak harus menerbitkan surat keterangan bebas pembayaran Pajak Penghasilan yang bersifat final paling lama 3 (tiga) hari kerja terhitung sejak jangka waktu sebagaimana dimaksud pada ayat (1) berakhir.
Pasal 4
(1) Dalam hal permohonan surat keterangan bebas pembayaran Pajak Penghasilan yang bersifat final sebagaimana dimaksud dalam Pasal 2 ayat (1) diterima, Kepala Kantor Pelayanan Pajak harus menerbitkan surat keterangan bebas pembayaran Pajak Penghasilan yang bersifat final dengan format sesuai lampiran III yang tidak terpisahkan dari Peraturan Direktur Jenderal Pajak ini.
(2) Dalam hal permohonan surat keterangan bebas pembayaran Pajak Penghasilan yang bersifat final sebagaimana dimaksud dalam Pasal 2 ayat (1) ditolak, Kepala Kantor Pelayanan Pajak harus menyampaikan pemberitahuan penolakan kepada Wajib Pajak dengan format sesuai lampiran IV yang tidak terpisahkan dari Peraturan Direktur Jenderal Pajak ini.
Pasal 5
Dalam hal ditemukan data atau keterangan lain yang menunjukkan ketidakbenaran data yang disampaikan oleh Wajib Pajak, surat keterangan bebas pembayaran Pajak Penghasilan yang bersifat final yang telah diterbitkan dinyatakan tidak berlaku dan Pajak Penghasilan ditagih kembali berikut sanksi sesuai dengan ketentuan Undang-Undang Nomor 6 Tahun 1983 tentang Ketentuan Umum dan Tata Cara Perpajakan sebagaimana telah beberapa kali diubah terakhir dengan Undang-Undang Nomor 16 Tahun 2009.
Pasal 6
Peraturan Direktur Jenderal Pajak ini mulai berlaku pada tanggal ditetapkan.
Agar setiap orang mengetahuinya, memerintahkan pengumuman Peraturan Direktur Jenderal Pajak ini dengan penempatannya dalam Berita Negara Republik Indonesia.

TENTANG
PEMBERIAN DISKON BAGI PEMILIK KARTU NPWP
DIREKTUR JENDERAL PAJAK,
Sehubungan dengan adanya kegiatan pemberian diskon oleh beberapa pengusaha bagi pemilik kartu Nomor Pokok Wajib Pajak (NPWP), dengan ini diberikan penegasan sebagai berikut :
1. Direktorat Jenderal Pajak (DJP) menyambut positif jika ada pengusaha yang secara sukarela, dengan berbagai pertimbangan bisnisnya, memberikan diskon terhadap pemilik NPWP;
2. Pemberian diskon kepada pemilik NPWP sepenuhnya merupakan inisiatif para pengusaha;
3. Direktorat Jenderal Pajak dengan nama dan dalam bentuk apapun tidak terkait dengan kegaiatan pemberian diskon bagi pemilik NPWP;
4. Kepala Kantor Wilayah DJP dan seluruh jajarannya tidak diperbolehkan secara aktif ikut berinisiatif atau bahkan berpartisipasi dalam kegiatan pemberian diskon bagi pemilik NPWP.
Demikian untuk menjadi perhatian dan dilaksanakan dengan sebaik-baiknya.

DIREKTUR JENDERAL PAJAK,
Sehubungan dengan adanya kegiatan pemberian diskon oleh beberapa pengusaha bagi pemilik kartu Nomor Pokok Wajib Pajak (NPWP), dengan ini diberikan penegasan sebagai berikut :

MENTERI KEUANGAN REPUBLIK INDONESIA,
Menimbang :
1. bahwa untuk keperluan pelunasan Bea Masuk, Pajak Pertambahan Nilai Barang dan Jasa dan Pajak Penjualan atas Barang Mewah, Pajak Ekspor, dan Pajak Penghasilan atas pemasukan barang, hutang Pajak yang berhubungan dengan Pajak Pertambahan Nilai Barang dan Jasa dan Pajak Penjualan atas Barang Mewah, Pajak Ekspor, dan penghasilan yang diterima atau diperoleh berupa uang asing, harus terlebih dahulu dinilai ke dalam uang rupiah;
2. bahwa berdasarkan pertimbangan sebagaimana dimaksud dalam huruf a, perlu menetapkan Keputusan Menteri Keuangan tentang Nilai Kurs sebagai Dasar Pelunasan Bea Masuk, Pajak Pertambahan Nilai Barang dan Jasa dan Pajak Penjualan atas Barang Mewah, Pajak Ekspor, dan Pajak Penghasilan yang berlaku untuk tanggal 27 April sampai dengan 03 Mei 2009.
Mengingat :
1. Undang-undang Nomor 7 Tahun 1983 tentang Pajak Penghasilan (Lembaran Negara Republik Indonesia Tahun 1983 Nomor 50, Tambahan Lembaran Negara Republik Indonesia Nomor 3263) sebagaimana telah diubah terakhir dengan Undang-undang Nomor 17 Tahun 2000 (Lembaran Negara Republik Indonesia Tahun 2000 Nomor 127, Tambahan Lembaran Negara Republik Indonesia Nomor 3985);
2. Pasal 2
Dalam hal kurs valuta asing lainnya tidak tercantum dalam Pasal 1 maka nilai kurs yang digunakan sebagai dasar pelunasan adalah kurs spot harian valuta asing yang bersangkutan di pasar internasional terhadap dolar Amerika Serikat yang berlaku pada penutupan hari kerja sebelumnya dan dikalikan kurs rupiah terhadap dolar Amerika Serikat sebagaimana ditetapkan dalam Keputusan Menteri Keuangan ini
Pasal 3
Keputusan Menteri Keuangan ini mulai berlaku pada tanggal 27 April 2009
Agar setiap orang mengetahuinya memerintahkan pengumuman Keputusan Menteri Keuangan ini dengan penempatannya dalam Berita Negara Republik Indonesia

Menimbang :
1. bahwa untuk keperluan pelunasan Bea Masuk, Pajak Pertambahan Nilai Barang dan Jasa dan Pajak Penjualan atas Barang Mewah, Pajak Ekspor, dan Pajak Penghasilan atas pemasukan barang, hutang Pajak yang berhubungan dengan Pajak Pertambahan Nilai Barang dan Jasa dan Pajak Penjualan atas Barang Mewah, Pajak Ekspor, dan penghasilan yang diterima atau diperoleh berupa uang asing, harus terlebih dahulu dinilai ke dalam uang rupiah;
2. bahwa berdasarkan pertimbangan sebagaimana dimaksud dalam huruf a, perlu menetapkan Keputusan Menteri Keuangan tentang Nilai Kurs sebagai Dasar Pelunasan Bea Masuk, Pajak Pertambahan Nilai Barang dan Jasa dan Pajak Penjualan atas Barang Mewah, Pajak Ekspor, dan Pajak Penghasilan yang berlaku untuk tanggal 27 April sampai dengan 03 Mei 2009.
Mengingat :
1. KEPUTUSAN MENTERI KEUANGAN TENTANG NILAI KURS SEBAGAI DASAR PELUNASAN BEA MASUK, PAJAK PERTAMBAHAN NILAI BARANG DAN JASA DAN PAJAK PENJUALAN ATAS BARANG MEWAH, PAJAK EKSPOR, DAN PAJAK PENGHASILAN YANG BERLAKU UNTUK TANGGAL 27 APRIL SAMPAI DENGAN 03 Mei 2009.
Pasal 1

She grew up in the South Shore community area of Chicago. Michelle graduated from Whitney Young High School in 1981 and went on to major in sociology and minor in African American studies at Princeton University, where she graduated 'cum laude' with a Bachelor of Arts in 1985. She mostly traces her roots to pre-Revolutionary War African Americans in the American South; much of her family still resides in the state of South Carolina.
At Princeton, Michelle challenged the teaching methodology for French because she felt that it should be more conversational. As part of her requirements for graduation, she wrote a thesis entitled, "Princeton-Educated Blacks and the Black Community". She obtained her Juris Doctor (J.D.) degree from Harvard Law School in 1988. While at Harvard, she participated in political demonstrations advocating the hiring of professors who are members of minorities.
After graduating from Harvard, Michelle accepted a position at a downtown Chicago law firm. In 1989 she was asked to mentor a summer associate from Harvard name Barack Obama. Their relationship started with a business lunch and then a community organization meeting where he first impressed her. The couple married in October 1992. They have only two daughters.

Avril Lavigne, actually Avril Ramona Lavigne, was born on September 27, 1984. Avril Lavigne is a Canadian pop punk singer/songwriter and actress who is well known for her "skater punk" persona. Her two albums to date, Let Go (2002) and Under My Skin (2004), have topped the charts in numerous countries. Although her name is of French origin, she herself does not speak French and her name is pronounced in an anglicized way, more or less as "La-veen" (although, actual pronunciation should be "La-Vine"). Her first name, Avril, means "April" in French and is pronounced "Av-reel" (anglicized "Ahv-ril").
Born in Belleville, Ontario to conservative Franco-Ontarian Christian parents John and Judy Lavigne, Avril grew up in Napanee; having moved there at the age of five. It was in Napanee that she sang country music and in a church choir and taught herself to play guitar. Avril Lavigne was discovered by her first professional manager, Cliff Fabri, while singing country covers at a Chapters bookstore in Kingston, Ontario. During a performance with the Lennox Community Theatre, Avril was spotted by Steve Medd, a local folksinger, who invited her to perform vocals on his song Touch The Sky for his 1999 album Quinte Spirit. Suitably impressed, he invited her back to perform vocals on Temple Of Life and Two Rivers for his followup album, My Window To You in 2000.
